Terms and Conditions

1. AGREEMENT TO TERMS

These Terms & Conditions govern your access to and use of the Zyloq mobile application and related services. By creating an account or using Zyloq, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

2. DEFINITIONS

• "Zyloq" refers to the power bank rental platform operated by Artus Guenes
• "User" refers to any individual who accesses or uses the Service
• "Power Bank" refers to portable charging devices made available for rent through Zyloq stations
• "Rental Period" refers to the duration from the time a power bank is rented until it is returned to a designated Zyloq station

3. ELIGIBILITY

To use Zyloq, you must:

• Be at least 18 years old or have legal capacity under applicable law
• Provide accurate and complete account information
• Have a valid payment method

Zyloq reserves the right to suspend or terminate accounts that do not meet eligibility requirements.

4. ACCOUNT REGISTRATION

Users must create an account to rent a power bank. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities conducted under your account

Zyloq is not liable for unauthorized access resulting from your failure to secure your account.

5. POWER BANK RENTAL

6. FEES AND PAYMENTS

• A 15.00 CHF deposit is charged at the start of each rental
• Usage is billed at 1.50 CHF per 30 minutes, capped at 9.00 CHF per day
• Upon return, the actual usage cost is calculated and the difference is refunded from the deposit
• If usage exceeds the deposit (e.g. multi-day rentals), the additional amount is charged automatically to your saved payment method
• Promotional free minutes, if available, are deducted from the billable duration before charges are calculated
• Payments are processed via Stripe using your selected payment method

Zyloq reserves the right to update pricing at any time, with notice provided in-app.

7. LATE RETURN, LOSS, OR DAMAGE

If a power bank is not returned within 48 hours:

• A penalty fee of 45.00 CHF is charged automatically to your saved payment method
• You will receive a notification informing you of the charge
• You may still return the power bank after the penalty — upon return, your actual usage cost is calculated (at the standard rate with the 9.00 CHF daily cap) and any overpayment is refunded
• If the power bank is lost, stolen, or damaged beyond normal wear and tear, the penalty fee is non-refundable
• Repeated failures to return may result in account suspension or termination

Zyloq will make up to 3 attempts to charge the penalty. If all attempts fail, your account may be restricted until the outstanding balance is resolved.

8. PROHIBITED USE

You agree not to:

• Use Zyloq for unlawful purposes
• Interfere with stations, software, or security systems
• Reverse engineer or attempt to access Zyloq systems
• Use the Service in a way that harms Zyloq or other users

Violations may result in immediate account termination.

9. SERVICE AVAILABILITY

Zyloq does not guarantee uninterrupted or error-free service. Availability may be affected by maintenance, network issues, technical failures, or station capacity.

10. LIMITATION OF LIABILITY

Zyloq shall not be liable for any indirect, incidental, or consequential damages arising out of or related to the use of the Service. Our total liability shall not exceed the amount paid by you for the specific rental in question.

11. INDEMNIFICATION

You agree to indemnify and hold harmless Zyloq, its affiliates, officers, and employees from any claims, losses, or damages arising from your use of the Service or violation of these Terms.

12. TERMINATION

Zyloq may suspend or terminate your account at any time for violation of these Terms. You may also delete your account at any time through the app.

13. PRIVACY

Your use of Zyloq is also governed by our Privacy Policy. Please review it to understand how we handle your personal information.

14. CHANGES TO THESE TERMS

We may update these Terms from time to time. Continued use of Zyloq after changes are posted constitutes your acceptance of the updated Terms.

15. GOVERNING LAW

These Terms are governed by and construed in accordance with the laws of Switzerland.
